PROMOTION PERIOD: The Bimbo® Your Groceries On Us Sweepstakes & Instant Win Game (the “Promotion”) starts on February 24, 2025 at 12:00 a.m. Eastern Time (“ET”) and ends on April 20, 2025 at 11:59 p.m. ET (“Promotion Period”). The Promotion will consist of a game of chance sweepstakes (“Sweepstakes”) and instant win game (“Instant Win”). The Promotion Period will consist of eight (8) separate weekly entry periods (each, an “Entry Period”), with each Entry Period beginning at 12:00 a.m. ET on a Monday, and ending at 11:59 p.m. ET the following Sunday throughout the Promotion Period.
ELIGIBILITY: Promotion is open to residents of the fifty (50) United States and the District of Columbia who are U.S. citizens or permanent residents at least 18 years of age at time of entry. Employees, officers, and directors of Bimbo Bakeries USA, Inc. (“Sponsor”), and Retail Sports Marketing, Inc. (“Administrator”), their respective subsidiaries, affiliates, distributors, promotion and advertising agencies, and members of their immediate families (spouse and parents, children and siblings and each of their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void where prohibited by law. Promotion is subject to all applicable federal, state and local laws.
HOW TO PARTICIPATE: During the Promotion Period, scan a QR code on Sponsor point of sale materials or media videos, or visit
www.BimboHelpingPaw.com to locate the Promotion online entry forms. Then, follow the instructions to complete and submit the online entry form to receive one (1) Sweepstakes entry and one (1) Instant Win game play for the applicable Entry Period. All Sweepstakes entries and Instant Win game plays must be received by April 20, 2025 at 11:59 p.m. ET to be considered. Sweepstakes entries and Instant Win game plays generated by script, macro or other automated means and entries by any means which subvert the entry process are void. Should your Instant Win game play result in a win, you will receive an on-screen message confirming if you are an instant winner and receive a subsequent winner confirmation email, sent to the email address you used to register for the Promotion. An email will be sent to the email address you used to register confirming your Instant Win prize.
LIMIT: Limit of one (1) Sweepstakes entry and one (1) Instant Win game play per person, per email address, per Entry Period. You may only use one (1) email address to participate in the Promotion. Any Instant Win game plays or Sweepstakes entries received from any person in excess of the limitation stated above will be void.
INSTANT WIN PROCESS AND ODDS OF WINNING: All Instant Win prizes will be time-seeded via random, pre-determined computer-generated winning times throughout the Promotion Period. If your game play, as described above, is the first one received on, or immediately after one of those predetermined times (if no game play is submitted on an exact winning time), it will be considered an Instant Win and you will be eligible to win the Instant Win prize designated to that winning time, subject to verification. If you receive a message that contains any message other than a winning prize message, you are not an Instant Win prize winner.
The number of Instant Win prizes available to be won will decrease throughout the Promotion Period as prizes are awarded and claimed. Odds of winning an Instant Win prize depend on the time of the day when you play (as recorded by the website server) during the Promotion Period, the number of game plays received and the order in which they are received. If you win an Instant Win prize, you are still eligible to win a Sweepstakes prize. Instant Win prizes will be delivered using the information provided during registration.
Instant Win game plays and Sweepstakes entries shall be deemed to be submitted by the authorized email account holder of the email address used to enter the Promotion. “Authorized Account Holder” of an email address is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. You may participate in the Promotion using an email address for which you are the Authorized Account Holder. An eligible Prize winner may be required to provide proof that they are the Authorized Account Holder associated with the selected email address. By submitting an email address to enter the Promotion, you represent and warrant that you are the Authorized Account Holder. You shall be responsible and liable to the Promotion Sponsor and otherwise for any damages and other losses incurred in connection by them as a result of your submission of any email address for which you are not the Authorized Account Holder. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the Authorized Account Holder of the email address provided at time of entry. Standard data rates may apply if the Promotion Website is accessed via a mobile device, and entrants are solely responsible for any such charges.
Entrants using any other device or artifice to enter multiple times above the stated limit or as multiple entrants will be disqualified. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Entries cannot be transferred between email addresses. Any incomplete entries will be considered ineligible. Proof of submission is not proof of receipt by Sponsor. By participating, entrants agree to abide by and be bound by these Official Rules and the Sponsor’s decisions.
SWEEPSTAKES RANDOM DRAWING: One (1) potential Sweepstakes Grand Prize winner will be selected in a random drawing for each Entry Period on or about the Monday following each Entry Period from among all eligible entries received throughout each Entry Period (for a total of eight (8) potential Sweepstakes prize winners throughout the Promotion Period). Odds of winning a Sweepstakes Grand Prize will depend upon the total number of eligible entries received throughout each Entry Period. Non-winning Sweepstakes entries from one Entry Period drawing will not carry over to subsequent Entry Period drawings, if any. Random drawings will be conducted by Administrator, whose decisions are final on all matters relating to this Promotion. Sponsor’s decisions are final and binding on all matters relating to this Promotion.
SWEEPSTAKES WINNER NOTIFICATION: Potential Grand Prize winners will be notified by Sponsor via email, phone and/or mail and will be required to respond to Sponsor within three (3) days from date of initial notification. Potential Grand Prize winners will be required to execute and return an affidavit of eligibility, a liability release, an IRS W-9 Form and, where lawful, a publicity release. If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, Sponsor is unable to contact a potential Grand Prize winner or a potential Grand Prize winner is not in compliance with these Official Rules, such prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected for the applicable prize.
SWEEPSTAKES PRIZES:
GRAND PRIZES (8) (One (1) awarded per Entry Period): Each Grand Prize winner will receive groceries for one (1) month, awarded in the form of a $1,000 gift card. Approximate Retail Value (“ARV”) of each Grand Prize: $1,000.00.
INSTANT WIN PRIZES:
TIER ONE (168) (Twenty one (21) per Entry Period): Each tier 1 prize winner will receive groceries for one (1) week, awarded in the form of a $250 gift card. ARV of each tier 1 prize: $250.00. TIER TWO (400) (Fifty (50) awarded per Entry Period): Each tier 2 prize winner will receive one (1) full-value coupon, redeemable for one (1) Bimbo product up to $12.00 in value. ARV of each tier 2 prize: $12.00.
PRIZE CONDITIONS: Limit of one (1) prize per person and per household throughout the Promotion Period. Exact manufacturer or retailer gift card awarded to Grand Prize winners to be determined by Sponsor, in its sole discretion. The total value of a coupon must be redeemed at one (1) transaction. Any unused balance will not be awarded. Coupons must be surrendered at time of redemption. Coupons are subject to certain terms and conditions specified by Sponsor. Coupons expire on date specified on each coupon. Coupons may not be used online or in conjunction with any other offer or discount. Valid only in the U.S.A. and are void where prohibited. Winners may not substitute or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified in these rules as being provided. All prize details are at Sponsor’s sole discretion. Prizes will be awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Total ARV of all prizes is $54,800.00.
Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to deliver the notification to selected winners. The total prizes will be shipped directly to the mailing address winner provided in their entry form. If a selected winner has moved to a different address, it is the sole responsibility of the selected winner to notify the Sponsor or designated agent of the selected winner’s new address. In the event of a dispute over the identity of a selected winner, the winner will be deemed to be the Authorized Account Holder of the email account/address used to enter the Promotion. “Authorized Account Holder” is defined as the natural person who is assigned to an email account/address. Sponsor will not be held responsible for any lost gift cards or coupons or any undeliverable or lost prize deliveries due to change of address. By accepting and/or using prize, except where prohibited, winners gives Sponsor, Administrator and its designees the rights to use winners’ name, voice, likeness, prize information, city and state of residence, video, voice, any comments, testimonials, or other feedback related to the prize, whether written or oral, in advertising, trade, or promotion, without further compensation worldwide in perpetuity and in any form of media, now known or hereafter developed, including the Internet, unless prohibited by law.
GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Promotion; (b) to release, discharge and hold harmless Sponsor, Administrator, their respective subsidiaries, affiliates, distributors, promotion and advertising agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Promotion or any Promotion-related activity or the acceptance, possession, use or misuse of any prizes; and (c) to the use of his/her name, voice, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor, its affiliates and agencies, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use.
Privacy: Information collected from entrants in connection with the Promotion (“Entrant Information”) will be subject to and may be used in accordance with the Privacy Policy posted on the Website (available at
www.bimbobakeriesusa.com/privacy-policy).
RELEASE AND ASSUMPTION OF RISK: By entering, each entrant, on behalf of the entrant and his or her heirs, executors, guardians, assigns, agents and representatives, releases each of the Released Parties, and all people and entities involved in the development or execution of the Promotion from and agrees not to assert any claims, actions, suits, proceedings and demands arising out of or relating to the conduct of or the entrant’s participation in the Promotion, the acceptance or use of the prize or any component thereof, travel to and/or participation in any prize-related activity, and all liabilities, losses, injuries and/or damages arising out of relating to the same. The foregoing includes, without limitation, any claims, actions, suits, proceedings or demands based upon or alleging any invasion of privacy, violation of right of publicity or infringement of any intellectual property or other personal or proprietary rights, or any personal injury or death to an entrant or any other person or any damage to or loss of personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize or any component thereof and any activity or travel related thereto or participation in this Promotion. Entrants assume all liability for and risk of any injury or damage caused, or claimed to be caused, by participation in this Promotion, the acceptance or use of the prize or any component thereof or travel to or participation in any prize-related activity.
MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries or social media posts, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries or social media posts, the announcement of the prize, or in any Promotion related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Promotion or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised for any reason, including virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion (or portion thereof) and, if terminated, at its discretion, select the potential winners from among all non-suspect, eligible entries received prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL AVAILABLE REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
ARBITRATION: Except where prohibited by law, as a condition of participating in this Promotion, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Promotion, or prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and entrant further waives all rights to have damages multiplied or increased.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the Commonwealth of Pennsylvania, USA.
